Personal Injury & Tort Liability

If someone else's negligence hurt you, you may be entitled to compensation for medical bills, lost income and what you have been through.

Scope

We help with

  • Car and motorcycle accidents
  • Slip-and-fall and premises liability
  • Workplace and construction accidents
  • Dog bites
  • Assault and battery
  • Medical malpractice
  • Wrongful death

What has to be shown

That the other party owed you a duty of care, fell below it, and that the failure caused your injury and the losses you claim: medical treatment, lost income and the effect on daily life. Causation is where these cases are most often contested.

Shared fault

Illinois reduces an award by the share of fault attributed to the injured person, and bars recovery where that share is more than half. That is why insurers work to show you were partly responsible, and why what is said at the scene and to an adjuster matters.

Deadlines

Injury claims have strict time limits. Claims against a city, a transit authority or another public body are shorter, and a separate notice can be required. A claim that misses its deadline usually ends there.

Common questions

What should I do right after an accident?

Get medical care, keep every record, bill and photo, write down the names of witnesses, and avoid giving a recorded statement to the other side's insurer before you get advice.

Do I have to talk to the insurance company?

You are not obliged to give a recorded statement to the other side's insurer, and there is rarely a reason to hurry. Statements given before the extent of an injury is known are often used to argue it was minor.

What if I was partly at fault?

In Illinois you can still recover if your share of fault is not more than half; the award is reduced by that share.
